Section 524 (Applicable Regulations) “… In the absence of a treaty or convention, the courts of the Republic shall comply with the rules included under this Title…”
Section 526 (Rules of Action) “… 526.1 In order to carry out any procedural acts of a merely formal nature abroad, such as notices, subpoenas and summons, as well as for the reception and procurement of evidence and reports, the court shall issue letters rogatory. The same solution shall be applied with respect to letters rogatory issued by foreign courts …”
Section 527 (Letters rogatory) “… 527.1 Letters rogatory may be transmitted by the involved person, by consular or diplomatic agents or through a competent administrative authority or otherwise by seeking the involvement of a court. 527.2 Legalization shall not be required when letters rogatory are transmitted by consular or diplomatic means or through an administrative authority. 527.3 Letters rogatory shall be transmitted pursuant to the procedural laws of the State of enforcement thereof. Upon the requesting jurisdictional body’s request, a court may follow any formalities or special procedures during the letter rogatory prosecution, provided the same are not inconsistent with domestic laws. 527.4 Letters rogatory and any documents attached must include, as the case may be, the respective translation …”
